5. AI-Powered Features

5.1 Nature of AI Services

Ausat uses artificial intelligence and machine learning algorithms to provide job recommendations, resume suggestions, and career insights. These AI-generated outputs are intended as recommendations and assistance tools, not as professional career advice, legal counsel, or guaranteed outcomes.

5.2 No Guarantee of Results

We do not guarantee that you will receive job offers, interviews, or any specific outcome from using our AI-powered features. Job matching scores, resume optimization suggestions, and career recommendations are generated algorithmically and should be used as one of many inputs in your job search process.

5.3 AI Accuracy

While we strive for accuracy, AI-generated content may contain errors, omissions, or biases. You are responsible for reviewing and verifying all AI-generated suggestions before acting on them, particularly in resumes and job applications submitted to employers.

6. Job Listings and Third-Party Content

6.1 Third-Party Listings

Ausat aggregates job listings from various sources including employer websites, government job portals, and partner platforms. We do not verify the accuracy, legality, or legitimacy of every listing. We are not the employer and do not make hiring decisions.

6.2 No Employment Relationship

Ausat is a technology platform that connects job seekers with opportunities. We are not an employment agency, staffing firm, or recruiter. No employment, agency, or partnership relationship is created between you and Ausat by your use of the Platform.

6.3 External Links

The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party site. Accessing external links is at your own risk.

7. Intellectual Property

7.1 Our Intellectual Property

All content, software, algorithms, designs, graphics, logos, trademarks, trade names, and other intellectual property on the Platform (excluding User Content) are owned by or licensed to Ausat and are protected by copyright, trademark, patent, and other intellectual property laws worldwide.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use in accordance with these Terms. This license does not include the right to copy, modify, distribute, sell, or lease any part of the Platform or its content.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Platform, you grant us the right to use, implement, and incorporate such feedback without any obligation to you and without compensation.

8. Fees and Payments

8.1 Free and Premium Services

Ausat may offer both free and premium (paid) tiers of service. Features available under each tier may change over time. We will clearly indicate which features require payment before you are charged.

8.2 Payment Terms

If you subscribe to a paid plan, you agree to pay all applicable fees. Payments are processed through third-party payment providers. You authorize us to charge your selected payment method for recurring subscriptions unless you cancel before the renewal date.

8.3 Refunds

Refund eligibility is determined on a case-by-case basis. If you are dissatisfied with a paid service, contact us at contact@ausat.ai within 14 days of purchase to request a review.

9. Account Suspension and Termination

9.1 By You

You may delete your account at any time through the Platform settings or by contacting us. Upon deletion, we will remove or anonymize your personal data in accordance with our Privacy Policy.

9.2 By Ausat

We reserve the right to suspend or terminate your account, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or posed a risk to the Platform, other users, or third parties. We may also terminate accounts that remain inactive for an extended period.

9.3 Effect of Termination

Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) will continue to apply.

10. Disclaimers

THE PLATFORM AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, AUSAT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, JOB LISTINGS, OR AI-GENERATED RECOMMENDATIONS.
  • WARRANTIES THAT THE PLATFORM WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.

We do not guarantee employment, interviews, or any particular outcome from using the Platform. Career decisions should be made using your own judgment and, where appropriate, professional advice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUSAT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities.
  • Loss of goodwill or reputation.
  • Cost of procurement of substitute services.
  • Any damages arising from unauthorized access to or alteration of your data.
  • Any damages resulting from your reliance on AI-generated content or job recommendations.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE AMOUNT YOU HAVE PAID TO AUSAT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ausat, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the Platform.
  • Your violation of these Terms.
  • Your violation of any applicable law or the rights of any third party.
  • Content you submit, post, or transmit through the Platform.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at contact@ausat.ai and attempt to resolve the dispute informally for at least 30 days.

13.2 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Ausat is incorporated, without regard to its conflict of law principles. If you are a consumer in the European Union, United Kingdom, or another jurisdiction that provides mandatory consumer protection laws, those protections will continue to apply.

13.3 Arbitration

Any disputes that cannot be resolved informally may be submitted to binding arbitration in accordance with the rules of a recognized arbitration institution. You agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action, to the extent permitted by applicable law.

14. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page and provide notice through the Platform or via email where required by law.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Platform and may delete your account.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Ausat regarding the use of the Platform.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Ausat.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

Ausat will not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, wars, terrorism, riots, power failures, internet outages, or cyberattacks.
